Use of Resources
Use of the Company’s Resources is conditioned on your compliance with these Terms.
You agree that:
- You are responsible for lawful use of all Resources
- You will comply with all applicable laws and regulations
- The Company may suspend or terminate access for violations
Communications & Consent (CIPA Compliance)
By using the Company’s Resources or engaging with the Company, you acknowledge and consent that:
- The Company may monitor, record, or store communications (including phone calls, emails, SMS, and platform activity) for training, compliance, and quality assurance purposes
- You are responsible for obtaining any required consent from individuals prior to recording or transmitting communications
- Where required by law (including California Invasion of Privacy Act (CIPA)), you agree to provide proper notice and obtain consent before recording any call or electronic communication
Outbound Communications & Legal Compliance
You agree that you will NOT:
- Sell, resell, or transfer leads without written authorization
- Use autodialers, prerecorded messages, spam texts, or automated calling systems
- Contact individuals without proper consent or Do-Not-Call (DNC) screening
- Contact any individual who has opted out of communication
- Use misleading, unapproved, or non-compliant marketing materials
You agree to comply with all applicable laws, including:
- TCPA (Telephone Consumer Protection Act)
- TSR (Telemarketing Sales Rule)
- CAN-SPAM Act
- HIPAA
- CCPA / CPRA (California Consumer Privacy Act)
- VPPA (Video Privacy Protection Act, where applicable)
- Medicare marketing rules and CMS guidance (if applicable)
Medicare Marketing Compliance (If Applicable)
If you engage in Medicare-related marketing, you agree that you will NOT:
- Conduct unsolicited telemarketing, SMS, or email outreach
- Contact prospects without authorization or Scope of Appointment
- Use unapproved CMS or carrier marketing materials
- Enroll individuals via outbound calls
- Engage in misleading or non-compliant Medicare communications
Communication With Agents
By engaging with the Company, you authorize communication via:
- Phone calls (including recorded calls where permitted by law)
- SMS/text messages
- Voicemail
- Other electronic communication channels
You may opt out of non-essential communications by notifying the Company.
Independent Contractor Relationship
Unless otherwise stated:
- Agents are independent contractors
- No employment relationship exists
- No partnership, joint venture, or agency relationship is created

Limitation of Liability
To the fullest extent permitted by law:
- The Company is not liable for indirect, incidental, special, consequential, or punitive damages
- Total liability shall not exceed the greater of:
- $1,000, OR
- Amounts paid by you to the Company for services or access
Agreement to Arbitrate
Any dispute arising from these Terms or use of Company Resources shall be resolved through binding arbitration.

- Administered by the American Arbitration Association (AAA)
- Location: Dallas, Texas
- No jury trials or class actions permitted
- Arbitration is final and binding
- This clause survives termination of your relationship with the Company
Waiver & Severability
- Failure to enforce any provision does not constitute a waiver
- If any provision is found invalid or unenforceable, the remaining provisions remain in full effect
